Criminal defence lawyers for Werribee and Wyndham

A criminal matter can develop quickly. You may receive a call from police, be asked to attend an interview or be released on bail with a court date before you have had time to understand the allegations.

Galbally Parker represents people from Werribee and across Wyndham in criminal, traffic and intervention order proceedings. Our lawyers appear at Wyndham Law Courts and can assist from the beginning of a police investigation through to the final court hearing.

The former Werribee Magistrates’ Court closed in October 2025 and was replaced by Wyndham Law Courts in November 2025. If your case began before the change, check the venue shown on your latest court documents before attending.

Our first step is to understand what police allege, what evidence is available and what decisions need to be made. From there, we can advise you about the available options and prepare a strategy for the next stage.

Representation at Wyndham Law Courts

A first court date is often a mention rather than a plea or contested hearing.

The Magistrate may need to know whether the police brief has been provided, how the accused person intends to respond to the charge and whether either party needs more time. Bail, intervention order conditions or related proceedings may also need to be addressed.

Before the hearing, our criminal lawyers can:

  • check the charges, court date and venue
  • review your summons, bail undertaking and other court documents
  • obtain and examine the police brief
  • identify evidence that should be challenged or collected
  • advise you about pleading guilty or not guilty
  • speak with police prosecutors
  • assess whether diversion, a caution or another alternative outcome may be available
  • prepare material for bail or sentencing
  • represent you at Wyndham Law Courts when required

Some matters can be resolved through discussions with the prosecution. Others require further investigation, expert evidence or a contested hearing.

What criminal matters are commonly dealt with in Werribee?

Wyndham Law Courts hears a broad mix of criminal, traffic and intervention order matters.

The cases requiring legal representation in Werribee commonly include theft and deception allegations, family violence proceedings, assault charges, driving offences, drug matters, youth offending and bail applications.

Some charges can be finalised in the Magistrates’ Court. More serious indictable cases may begin at Wyndham Law Courts before being transferred to the County Court or Supreme Court.

Property and dishonesty allegations can arise from shop theft, burglary, handling stolen goods, online sales, access to another person’s account or obtaining money or property by deception.

These cases frequently involve a large amount of electronic evidence. Police may rely on:

  • CCTV footage
  • online marketplace advertisements
  • messages between buyers and sellers
  • banking records
  • account access logs
  • mobile phone data
  • delivery or collection records

A suspicious transaction does not, by itself, establish criminal responsibility. The prosecution must still prove who was involved and whether that person acted knowingly or dishonestly.

Galbally Parker represents clients facing theft, burglary and robbery charges as well as more complex fraud allegations.

Our article on strategic defence for fraud charges in Victoria explains some of the evidence and legal issues that can arise in these cases.

A police response to an alleged family violence incident can lead to several proceedings at once.

A person may be served with a Family Violence Safety Notice, placed on bail and charged with an offence arising from the same incident. Conditions can prevent them from returning home or contacting family members before the allegations have been tested in court.

Related charges may include:

  • assault
  • threats
  • property damage
  • stalking
  • breaching an intervention order
  • contravening a Family Violence Safety Notice

Our family violence lawyers advise on both the criminal charges and the intervention order proceedings.

You can also read our guide to family violence intervention orders and criminal charges or learn what to do if you have been served with an intervention order.

Assault cases often come down to conflicting accounts of a fast-moving incident.

A witness may have seen only part of what occurred. CCTV can begin after the confrontation started or fail to capture important details outside the camera frame. Phone footage and body-worn camera recordings may provide further context, but they must be considered alongside the rest of the evidence.

We examine:

  • what happened before and during the incident
  • whether the witnesses are consistent
  • whether the accused person has been correctly identified
  • whether self-defence may apply
  • whether the prosecution can prove the required intention

Many people living and working across Wyndham rely heavily on their licence. A disqualification can affect employment, education, childcare and other family responsibilities.

Driving matters heard in the Magistrates’ Court may include:

  • drink driving
  • drug driving
  • driving while suspended or disqualified
  • careless driving
  • dangerous driving
  • conduct endangering life or serious injury
  • failing to stop after a collision

The consequences may extend beyond a fine. Depending on the charge, the court can impose licence cancellation, disqualification, a community order or imprisonment.

Our driving offence lawyers can assess the evidence, explain the likely licence consequences and prepare the matter for court.

Drug charges may follow a vehicle search, the execution of a search warrant or an investigation involving phone and financial records.

Possession is not always straightforward. Drugs found in a shared house, vehicle or storage area do not automatically establish who owned or controlled them.

Trafficking allegations may rely on a combination of evidence, including:

  • text messages
  • phone contacts
  • cash
  • scales or packaging
  • bank transfers
  • surveillance
  • the quantity and form of the substance

Our drug offence lawyers represent clients charged with possession, trafficking, cultivation and commercial quantity offences.

For a young person with little or no criminal history, the way a matter is handled early can have a significant effect on the outcome.

Age, health, substance dependence, education, family support and willingness to participate in treatment may all be relevant. Police may also consider whether a caution, diversion or referral to a support service is more appropriate than a prosecution.

Victoria Police’s Youth Crime Prevention and Early Intervention Program applies to eligible young people accused of lower-level offending. It can involve cautions, warnings, diversion and referrals designed to address the factors contributing to the behaviour.

Legal advice can help identify whether an alternative resolution should be raised before the case progresses further.

A bail application needs practical evidence and a workable release plan.

The court may want information about:

  • where the accused person will live
  • whether they have employment or study commitments
  • who can provide supervision or support
  • whether drug, alcohol or mental health treatment has been arranged
  • how contact with particular people can be restricted
  • what conditions could reduce any alleged risk

Our bail application lawyers prepare and present applications in the Magistrates’, County and Supreme Courts.

Our bail application information guide explains the information clients and families may need to gather before the hearing.

Galbally Parker Case Study from Werribee

Galbally Parker acted for Neftalem Abraham, a 21-year-old man charged with negligently dealing with proceeds of crime.

The charge arose after gaming consoles were falsely advertised for sale online. He had placed the advertisements in an attempt to obtain money to support a drug addiction.

The allegation was serious, but it did not tell the full story.

Our client had no prior criminal history. His age, medical circumstances and drug dependence were also highly relevant to how the matter could be resolved.

He was assessed as suitable for Wyndham Police’s Youth Crime Prevention and Early Intervention Project. The program is designed to address lower-level offending by eligible young people through measures such as formal cautions, diversion and referrals to support services.

After participating in the program, our client received a formal police caution.

The charge was withdrawn and struck out.

No conviction was imposed.

This result shows why a lawyer should look beyond the wording of the charge. The client’s background, health and eligibility for an alternative process changed the course of the matter.

What should you do if Werribee Police contact you?

Werribee Police Station is located at 134–140 Princes Highway, Werribee. Its reception counter and telephone service operate 24 hours a day.

Police may call you, attend your home or ask you to come to the station for a recorded interview.

Do not assume an interview is simply an opportunity to explain what happened. It is an evidence-gathering process. Your answers may later be used to support the prosecution case.

Before attending, you should understand:

  • what offence police are investigating
  • whether you are under arrest
  • whether police intend to charge you
  • whether your release or bail will be opposed
  • your options during the interview
  • the consequences of answering or declining to answer particular questions

Our police interview lawyers can advise you before you speak to investigators.

Advice given before an interview is generally far more useful than attempting to correct a damaging answer later.

Attending Wyndham Law Courts

Wyndham Law Courts opened to the public on 10 November 2025, replacing the former Werribee Magistrates’ Court.

Check the venue printed on your latest:

  • charge and summons
  • bail undertaking
  • notice to appear
  • intervention order documents
  • hearing notice

The court listed on those documents is the venue you are ordinarily required to attend. The Magistrates’ Court also provides information about finding the correct court venue.

You can use the court’s online hearing search to check your listing by name, court or date.

Bring:

  • your charge sheet or summons
  • bail paperwork
  • your hearing notice
  • intervention order documents, where relevant
  • photo identification
  • any reports or supporting material requested by your lawyer

Allow enough time to enter the building and pass through security. Your matter may not be heard at the time shown on your notice, particularly if your lawyer needs to speak with the prosecution first.

Serious indictable matters can begin in the Magistrates’ Court before progressing to a higher court. Our guide to committal hearings explains what happens during that process.

Why choose Galbally Parker for a Werribee matter?

Criminal law is not a small part of a broader general practice.

The charge sheet is only the starting point.

Depending on the case, our work may involve:

  • reviewing CCTV and body-worn camera footage
  • checking phone and financial records
  • obtaining medical or treatment material
  • examining the legality of a search
  • testing witness accounts
  • negotiating the withdrawal or reduction of charges
  • assessing eligibility for diversion or a caution
  • preparing bail and sentencing material

The best strategy depends on the evidence and the client’s circumstances, not on a standard response to the offence name.

Legal proceedings are difficult enough without unclear advice.

We explain where the matter stands, what needs to happen next and which decisions you will need to make. We also discuss the risks and limitations of each option.

A strong appearance usually depends on work completed beforehand.

That may include conferences, legal research, negotiations with the prosecution, expert advice and supporting reports. When the case is called, the position being put to the court should already be clear.
